The European Court of Human Rights (ECtHR) has found in the case of Mo.M. v France that the deportation of the applicant to Chad, where he had previously been a victim of torture, would be a violation of the prohibition of torture and inhuman or degrading treatment under Article 3 of the European Convention on Human Rights (ECHR). The applicant had requested asylum in France, but his application was rejected and he was ordered to return to Chad.

The Court held that the situation in Chad was still dangerous, especially for persons who, like the applicant, are suspected by the Chadian authorities of collaboration with rebel groups. The Court found that the applicant had indeed been a victim of torture in Chad and that he would run a real risk of suffering similar treatment again if he were returned there.
