Marco
Marco, from Cuba, arrived in the Netherlands having used a false passport. When apprehended at Schiphol airport, he immediately admitted to having travelled with a false passport but also indicated he had no other way of fleeing his country and expressed his wish to apply for asylum in Spain because his brother resided there.
Marco did not receive any information on the Dublin Regulation, and therefore was unaware that he would be unable to travel onwards to Spain to request asylum. Therefore, he did not initially apply for asylum in the Netherlands, as he thought he would be able to do it in Spain.
Marco was denied entry to the Netherlands and placed in detention. Throughout the procedure he did not receive legal assistance despite requesting to see a lawyer. After spending three months in detention Marco managed to receive legal assistance and applied for asylum in the Netherlands.
